From the Medicaid Coalition regarding the elimination of Retroactive "ligibility
Just in case you haven't seen this already, New Jersey's waiver was just approved but their elimination of retroactive eligibility request was not approved, as CMS stated that this would be a maintenance of effort violation. The language is below. We thought that we should let you know given New Mexico's similar request.
xThe elimination retroactive eligibility for most populations would constitute a more restrictive eligibility procedure than those in place on March 23, 2010 and thus would violate the Maintenance ofEffort (MOE) provisions of the Affordable Care Act. The demonstration does not include this authority.
